Employment Law

We not only advise our clients on the current legal situation, but work with them to develop solutions to their practical problems in all areas of employment law, both individual and collective. We design all types of contract relevant under employment law, conduct negotiations on reconciliation of interests and welfare schemes, represent our clients at proceedings before arbitration tribunals, and provide legal advice and support for restructuring and for corporate deals.

Our clients are adviced by us on creating and terminating employment contracts and we undertake the draft of contracts for companies and managers. Furthermore, we provide strategic advice on the termination of contracts, and implement dismissal notices and termination agreements. These processes naturally include enforcement by legal proceedings, and conflict management.

For clients undertaking restructuring and substantial changes to business operations, including M&A deals and outsourcing, we provide our clients with legal and strategic advice during negotiations with the works or staff council and with the authorities, and support them by means of viability studies and expert evaluations. We advise our clients on preparing strategically for transfer or change of business operations and on effecting such transfers once prepared, aid and assist them at all stages of a deal, and redesign all employment contracts. In all these areas we also undertake representation before employment tribunals.

Our advice in periods of crisis includes drawing up and carrying out strategies for reorganisation and reconstruction, downsizing of workforce, plant closures and plant relocations, wage and salary reductions, and the introduction of short-time working. We also provide comprehensive advice on all questions of employment law relating to insolvencies.

In Collective employment law we advise on all questions of works council constitution law, particularly in scrutinising co-determination rights, representing clients in arbitration-tribunal proceedings, providing support for reconciliations of interest and statutory welfare schemes, and drawing up works agreements. In the law governing wage and salary agreements, we advise clients on changing the official scale or rescinding wage and salary agreements, and on designing modern systems of remuneration under official scales. We are also frequently engaged in questions of employee co-determination on supervisory boards. In addition, we support our clients in choosing the right business model to satisfy works-constitution and co-determination law and the law governing wage and salary agreements.
